Proceso legislativo en el estado de veracruz

INTRODUCCIÓN

El Poder Legislativo es aquel en que reside la potestad de hacer y reformar las leyes, en los estados de derecho democrático de división de poderes, donde desde la Constitución se da al poder legislativo la competencia y prerrogativa de expedir las leyes. Tal es el caso del Estado de Veracruz.

El presente trabajo denominado El Procedimiento Legislativo en el Estado deVeracruz, se sitúa en un contexto sumamente práctico y actual acerca del proceso de elaboración de una Ley o Decreto en el ámbito local, esto es, del Estado de Veracruz de Ignacio de la Llave; generalmente el análisis de la manera de crear una norma es desde el ámbito federal, de ahí la importancia de esta investigación, ya que se centra en el Estado Veracruzano, desde siempre pionero en la prácticalegislativa.

El desarrollo de esta obra se divide en dos capítulos, en el primero se aborda el estudio del Poder Legislativo Local, esto es, su historia, integración, facultades, así como la técnica legislativa empleada por los legisladores del Estado; y en el segundo se desarrollan cada una de las fases del procedimiento legislativo en el Estado de Veracruz, tocando el fondo de la iniciativade Ley o Decreto ante el Pleno o Diputación Permanente, el turno a Comisiones, la elaboración del Dictamen y su discusión, la sanción del ejecutivo, su promulgación, publicación y entrada en vigor de la Ley o Decreto; también se expone la figura del veto del Ejecutivo Estatal.

El objetivo de esta investigación es provocar en el lector una reflexión acerca de las funciones del poderlegislativo a nivel estatal. Si bien no hay bibliografía especializada en derecho constitucional de las entidades federativas, si es posible acceder a los textos de las Constituciones del Estado de Veracruz, y de ellos obtener la información con la que fue posible la elaboración de este trabajo.

También cabe destacar que el papel que juega el ciudadano Veracruzano en el proceso creador de la norma nodebe ser pasivo, al contrario su labor es o debe ser activa, ya que como se expone en esta investigación puede mediante la iniciativa popular incitar esta maquinaria de creación de leyes locales.

Entonces por los motivos ya anotados y por el interés que me despierta el procedimiento legislativo del Estado de Veracruz, es que se producen estas líneas encaminadas a incrementar el mínimo acervobibliográfico que existe a nivel local del tema; ojalá sirva para que en un futuro se despierte el interés de los ciudadanos no sólo de este bello rincón Veracruzano, sino de toda la República Mexicana, por escribir sobre estos temas, sin duda de gran interés.

CAPÍTULO I PODER LEGISLATIVO LOCAL

En este país, Estados UnidosMexicanos, de acuerdo con la Constitución federal, se adopta como forma de gobierno una república democrática, representativa y federal, y se estructura atendiendo a la división de poderes, por el poder Ejecutivo, el poder Legislativo y el poder Judicial.
México es una federación compuesta de Estados libres y soberanos en todo lo concerniente a su régimen interior; como es el caso del Estado deVeracruz de Ignacio de la Llave, (artículo 40 de la Constitución Política de los Estados Unidos Mexicanos), por lo tanto cuenta con una estructura orgánica que se ubica también como en el orden federal en la división de poderes, como bien lo señala Máximo N. Gámiz Parral, así el poder Ejecutivo está a cargo del Gobernador del Estado, el poder Judicial es encabezado por el Tribunal Superior deJusticia y el poder Legislativo queda integrado por los diputados que componen el Congreso del Estado.[1]
El Congreso del Estado o la legislatura local es un órgano colegiado en el que se deposita la función legislativa reservada a los Estados, con pluralidad democrática porque en él convergen distintas corrientes políticas y por lo tanto ideológicas, ya que los diputados que lo integran…
