Los suscritos, Diputados integrantes de la Coalición Parlamentaria de Izquierdas, con fundamento en lo dispuesto por el Artículo 122, Apartado C, Base Primera, fracción V, inciso h) de la Constitución Política de los Estados Unidos Mexicanos; Artículos 36, 42 Fracción XII y 46 Fracción I del Estatuto de Gobierno del Distrito Federal; 1°,7°, 10, Fracción I, 17 Fracción IV de la Ley Orgánica de la Asamblea Legislativa del Distrito Federal; y 85 Fracción I del Reglamento para el Gobierno Interior de la Asamblea Legislativa del Distrito Federal, sometemos a la consideración del Pleno el presente DECRETO POR EL QUE SE REFORMAN Y ADICIONAN DIVERSAS DISPOSICIONES DEL CÓDIGO PENAL DEL DISTRITO FEDERAL Y SE CREA LA LEY CONTRA ELSECUESTRO DEL DISTRITO FEDERAL, al tenor de la siguiente:

EXPOSICION DE MOTIVOS De acuerdo con distintas mediciones estadísticas en materia de crimen organizado y secuestrosrealizadas por organizaciones de corte nacional e internacional1, México destaca como uno de los países con mayor incidencia e impunidad. Sobresale también, como un país caracterizado por presentar un sistema de administración y procuración de justicia plagado de inconsistencias judiciales en el impulso y procesamiento de causas penales: 8 de cada 10 investigaciones judiciales con implicacionespenales contienen errores o inconsistencias que debilitan el procedimiento y terminan por anularlo.

Cifras del Sistema Nacional de Seguridad Pública que opera y administra la Procuraduría General de la República, indican que el secuestro en el país es ya uno de los delitos que muestra un crecimiento alarmante: entre los años 2006 y 2007 este delito aumentó 35 por ciento su incidencia al pasar de325 casos reportados y denunciados en 2006 a 438 casos durante el año 2007.

En la ciudad de México, durante el primer semestre de 2008 se reportaron 44 secuestros en el Distrito Federal a diferencia de los 25 casos denunciados durante el mismo periodo de 2007. Esta cifra, sin embargo, es muy probable que no contemple secuestros de tipo exprés o aquellos que por cuestiones de seguridad no seregistran o permanecen como dato reservado en los archivos de la Procuraduría General de Justicia del Distrito Federal.

Con base en la información estadística del propio Sistema Nacional de Seguridad, el Consejo Ciudadano para la Seguridad Pública y la Justicia Penal ha informado que durante el año 2007, lossecuestros se incrementaron en todo el país en un 33 por ciento con relación a año 2006 y en un 56 por ciento con relación al año 2005. De igual forma, en 21 de las 32 entidades federativas se experimentaron incrementos y tan sólo en dos de ellas no existió variación.

En los últimos tres lustros, ocho de cada 100 secuestros realizados en México concluyeron con el asesinato de la víctima. La etapa máscrítica tuvo lugar durante el sexenio de Vicente Fox, cuando 339 plagiados no regresaron con vida a sus casas. De 1994 a 2007 ocurrieron en el país 7 mil 836 secuestros, con un saldo de 650 personas asesinadas. Destaca el año de 1997 con más de mil denuncias registradas. El año que menos secuestros experimentó fue 2005 con 278 secuestros y 78 víctimas inocentes.
